Classificação da áreaMunicipality zoning is structured by PDMM categories for: (i) Urban Space and (ii) Urbanizable Space, plus specific green, industrial, agricultural/agro-forestry/forest, aquaculture, public-interest installations, defense/port/telecom areas, and infrastructure-related easement/space. Urban Space sub-classes: a.1 mixed urbanized area; a.2 residential urbanized area; a.3 equipment urbanized area; a.4 industrial urbanized area. Urbanizable Space sub-classes: uM (mixed), uH (residential), uE (equipment), uI (industrial). Also includes Urban Green Space categories: VE (urban green/equipped), VP (protection and framing), VA (agricultural green).
Limite geral de alturaNo single municipality-wide height limit is stated. Maximum number of floors is defined by level/type (e.g., up to 5 floors in Level I C; examples given: 4 floors for Level I P; 2 floors for Level I R; 3 floors for Level II P/C; 2 floors for Level III R).
Pontos-chave
  • Preservation Zone (P): prohibition of significant increases in floor area and population density; prevent progressive tertiarization/specialization; promote revitalization.
  • Consolidated Zone (C): new construction allowed in interstitial unfilled spaces while maintaining prevailing typology, number of floors, road layout, eaves/cornices (cérceas) and predominant volumetry.
  • Urban/urbanizable areas are subdivided into classes with limits set in the planning map; dense parameters vary by “levels”.
  • No-construction area for urban infrastructure/buildings: prohibition of municipal licensing of urban subdivision (loteamento urbano) and construction.
  • Industrial regime: industrial/warehouse/support services/wholesale and large-surface trade located outside integrable urbanizable/urban space; oriented by structuring road network and sanitation/supply infrastructure; industrial areas must include green protection/framing and effluent treatment (Art. 24.º).
  • Environmental constraints apply broadly via REN and multiple easements (e.g., flood-related restrictions, non-aedificandi strips).
  • Provisional classification applies under consultation (Artigo 93.º) for areas adjacent to land submerged by the centennial flood until new delimitation.
Planos futuros
  • Revitalization objective for the Preservation Zone (P) (within-use strategy, not tied to a specific project).
NotasDimensional regime is managed primarily through density/indices and by “levels” rather than a single plot size or single height cap: maximum global density values by level (50/40/30/20/15 dwellings/ha) and maximum net density (65/50/40/30/20 dwellings/ha); maximum occupancy index 0.25; maximum utilization index varies by level (e.g., 0.80/0.60/0.50/0.45/0.40). Example setbacks/standards mentioned (for proposed AI): front 10 m, rear 10 m, sides 5 m. Specific environmental bands referenced include: aquaculture protection strip 200 m from NPA; bank protection strips 10 m and flood zones 100 m; non-aedificandi strips 5 m near water pipes and 200 m near WWTP (ETAR); view/landscape protection via view-systems; and licensing in protection strips conditioned to DRARNLVT and opinions of municipal commissions for protected zones/areas of classified properties (50 m protection zone).

  • Art. Article 9 — Categories of Urban SpaceUrban-space categories are defined. Area urbanizada mista is the central area characterising the urban area and the urban space where equipment, commerce, services, housing and public open areas are mixed; area urbanizada habitacional is predominantly housing, equipment and local commerce, occupying at least 70% of the urbanised area; area urbanizada de equipamento is predominantly equipment, occupying at least 70%; area urbanizada industrial is predominantly C and D class industries, warehouses and support services, compatible with housing, occupying at least 70%.
  • Art. Article 8 — Urban SpaceUrban space is characterised by a high level of urban infrastructure and population density. It consists of a coherent set of multifunctional buildings developed along a structuring road network, intended for urban use, including consolidated urban space and space under completion, rehabilitation or improvement within an urban area perimeter.
  • Art. Article 12 — General Rules for Urbanisation and Building in Urban SpaceGeneral rules for urban space urbanisation and building. It repeats the urban-space parameter table by urban levels and zoning (P/C/R), and adds several binding conditions: new urbanisation or building must respect the existing consolidated alignment, with protruding bodies conditioned, and maintain the average and dominant height of neighbouring buildings; building/urbanisation is forbidden on land with average slope above 20/100, in watercourse protection strips and in flood-prone zones; industrial establishments are forbidden if they occupy more than 3,0 ha or have a waterproofing index above 0,60 of the plot area, or if they are insalubrious, toxic, inconvenient or dangerous; in the urban space under the IC easement, lotting/urbanisation/building must comply with that easement; in the city of Montijo public parking must be implemented with adequate capacity. The article also states that 2.1 and 2.2 parameters apply only when creating plots with a logradouro, and that in lotting under 0,5 ha only parameters 1.3 and 1.5 apply; in non-lotting buildings only existing or studied alignment may be considered; only one-storey annexes are allowed in the rear yard/interior of blocks, except certain traditional 'pátios'.
  • Art. Article 11 — Parameters to Observe in the Urbanisation of Urban SpaceUrban-space urbanisation parameters by urban level and zone (P/C/R). It sets global density, net density, footprint index, gross construction index and maximum number of floors for each combination of level I, levels II/III, and levels IV/V with zones P, C and R. It also states that 150 m² of built floor area above ground equals 1 dwelling when dwellings are not characterised, that the zone-a-preserve area of Montijo has a special temporary rule allowing retained floor area of buildings to be demolished, provided the table parameters and dominant cércea are respected, and that in reabilitation zones corresponding to illegal settlements only urban lots on street fronts may be created, with minimum infrastructure of electricity and water.

In consolidated zones, construction is allowed in remaining interstitial spaces while maintaining the typological characteristics, number of floors, streets, cérceas and prevailing volumetry. In areas not yet identified and delimited, urban-space planning parameters correspond to those of area urbanizada mista / zone a preservar. The municipality must ensure coherent consolidation of the urban structure and the progressive implementation of categories and zones.
  • Art. Article 42 — Municipal Road and Path NetworkSets non-buildable strips for municipal roads and paths: 8 m for general building near municipal roads/forest roads, 50 m for warehouses, industrial establishments or other traffic-congesting buildings; 6 m and 30 m respectively for municipal paths; 10 m and 50 m respectively for national roads handed over to the municipality; inside urban perimeters, until plans are approved, alignment plans apply with minimum setbacks of 8 m to the axis for general building and 20 m for traffic-congesting building.
  • Art.
