The regime in the previous article applies with adaptations according to the use, except that the floor-area subrule ii) of paragraph 1 does not apply to pre-existing buildings, except for changes of use to housing. Extensions needed for the proper development of the activity may exceed the indices in the applicable subparagraphs if duly confirmed by the licensing authority. Works must comply with maximum construction areas by use, may include caves under Article 35.º, and must preserve landscape integration, safety, and original architectural character. In RNES, these works follow Article 52.º.
  • Art. Article 62 — Tourism enterprises in rural land and tourism intensityAllows tourism enterprises in rural land, which may take the form of ETI or NDT, subject to exceptions for the Costa Alentejana, the use regime of each category and other applicable constraints.
  • Art. Article 47 — Territorial insertion criteriaSets buildability and siting criteria for NDT. Minimum area is 50 hectares, minimum capacity is 200 camas, maximum number of floors is two, and maximum soil impermeabilisation index is 0,2. The solution must promote concentration of the building, infrastructure ratio must be below 30 %, common green/open space per accommodation unit must exceed 100 m2, and the structure must integrate with ecological structure. Areas of holm oak and cork oak stands must be delimited and incorporated into the ecological structure, and building is not allowed there.
  • Art. Article 45 — Areas for exclusion and irrigation infrastructure of hydro-agricultural schemesProtects irrigation transport and distribution infrastructure and its protection strips in rural and urban land. Building, roads, parking and tree planting are prohibited within a 5 m strip on each side of the outer limits of irrigation channels or the axis of water conveyance pipes. In areas benefited by hydro-agricultural schemes subject to reclassification or requalification, no urban operations are allowed without prior exclusion from the benefited area.
  • Art. Article 48 — Infrastructure requirementsAny building, development, installation or activity can only be approved if the site has suitable road access for mobility and emergency vehicles, or if such access is built with the project. The same applies to the necessary basic infrastructures, including water supply, wastewater drainage, electricity and others. Where public infrastructure networks are absent and this does not bar feasibility, effective and environmentally sustainable individual solutions must be provided. In rural land, if buildings are not served by wastewater systems, sealed septic tanks proportionate to the buildings are mandatory. If the building is more than 30 m from the nearest public road, a service access is required.
  • Art. Article 15 — Fire-fighting measuresFor rural land, all buildings, infrastructure and equipment are subject to forest fire defence measures under the national forest fire system and the municipal forest fire plan. New rural buildings must respect the applicable fire-management strip rules and special measures regarding fire resistance and ignition containment.
